3.2.1 · Legal and Regulatory Capacity

Tenderers must prove that they have the legal capacity to perform the contract and the regulatory capacity to pursue the professional activity necessary to carry out the work subject to this call for tenders.

3.2.2 · Economic and Financial Capacity

The tenderer shall have at the date of the deadline for submission of tenders a long-term credit rating corresponding to at least one of the following minimum levels: · A3 (Moody's), or · A- (Standard & Poor's), or · A- (Fitch Ratings), or an equivalent rating from another recognised credit rating agency/body.

3.2.2 · Economic and Financial Capacity

The contractor shall possess an appropriate deposit guarantee in line with the applicable law.

3.2.3 · Technical and Professional Capacity

Tool: use of an online banking system. Your bank shall use an online banking system, such as 'Isabel' or equivalent, in conjunction with the Agency's ERP-SAP S/4HANA, enabling EASA to make and receive daily payments. This shall ensure the security and the required controls on all banking operations (transfers, access to the account, etc.) in accordance to EASA's rules and regulations (i.e. minimum 2 signatures required for any operation).

3.2.3 · Technical and Professional Capacity

Account Manager: A dedicated Account Manager shall be provided, who can provide support on both technical and non-technical aspects, available at business hours.

Involved entities and all subcontractors, including those which do not need to be identified in the tender, must not be subject to professional conflicting interests which may negatively affect the contract performance. Where the contracting authority has established such conflicting interests, it may conclude that the tenderer or an involved entity does not possess the required professional capacity to perform the contract to an appropriate quality standard.
