3.2.1 · Legal and Regulatory Capacity

The tenderers must prove that they have the legal capacity to perform the contract and the regulatory capacity to carry out the professional activity necessary for the performance of the works covered by this call for tenders. The legal and regulatory capacity is proven by the following supporting documents: proof of registration in a relevant commercial or professional register; proof of the authorisation enabling the tenderer to perform the contract in its country of establishment; proof that the tenderer is a member of a specific professional organisation; constitutive document(s) and/or statutes of the economic operator, with their latest update(s), or the relevant extract(s) from these documents; any other document from a competent public body/authority in accordance with the legislation of the country in which the tenderer is established (e.g. trade register), clearly showing: its exact name, its corporate purpose which must be related to the subject matter of the contract, the signing powers. Economic operators must be incorporated and/or registered in accordance with the legislation of the country in which they are established. The corporate purpose of economic operators must be related to the subject matter of the contract. Economic operators must not be in a situation of conflict of interest that could affect the performance of the contract.
