The tenderer is required to fulfil the following condition: be enrolled in a relevant professional or trade register or have a specific authorisation in the country of establishment. Tenderers should have all the necessary authorisations or equivalent to perform the contract, in accordance with the legal provisions of Act No. 251/2012 Coll. on energy and amendments to certain acts as amended, as well as with all the complementary legal requirements relating to the electricity market. The European Parliament reserves the right to request appropriate evidence.
Tenderers shall have sufficient economic and financial resources to enable them to perform the contract in compliance with the contractual provisions, given the value and scope thereof. The European Parliament reserves the right to request appropriate evidence. The tenderer may also rely on the capacity of other entities, irrespective of the legal nature of the links between him and those entities. In that case, the relevant legal entity should have the relevant financial resources needed to perform the contract. On the same basis, a consortium of economic operators may rely on the capacity of members of the group or of other entities. Tenderers may also rely on the economic capacities of one or more subcontractors in so far as they undertake to take part in the process of performing the contract. In such instances, the European Parliament reserves the right to request appropriate evidence.

The technical capacity is assessed by the European Parliament based on their capacity to provide electricity supply. The European Parliament reserves the right to request appropriate evidence. The tenderer or candidate may also rely on the capacity of other entities, irrespective of the legal nature of the links between himself and those entities. In that case, the relevant legal entity should have the relevant financial resources needed to perform the contract. On the same basis, a consortium of economic operators may rely on the capacity of members of the group or of other entities. At all events, tenderers may always rely on the technical and professional capacities of one or more subcontractors in so far as they undertake to take part in the process of performing the contract. In such instances, the European Parliament reserves the right to request appropriate evidence. All entities, including subcontractors, on which the economic operator intends to rely for the required capacities, as well as other subcontractors whose share of the contract exceeds 20%, must submit the Tender form duly signed by the representative of the company.
