Tenderers can be natural or legal persons. Tenderers are not obliged to take a specific legal form to submit their tenders. Where tenderers submit a tender through an entity, which lacks legal personality (e.g., a branch), the compliance with the exclusion criteria, selection criteria, the rules on access to procurement as well as the absence of restrictive measures shall be assessed at the level of the tenderers. Tenderers do not need to prove specific legal and regulatory capacity to perform the contract.
Tenderers must comply with the following selection criteria to prove the necessary economic and financial capacity to perform the contract. Average yearly turnover of the last two financial years above EUR 1 800 000 is the minimum requirement.
Solvency ratio between Total debt and Equity between 6 and 0. Total debt is external funding, which consists of: - Short-term debt (money which an entity has to pay within 1 year after the current financial period), e.g. EC-prefinancing to be implemented Y+1. - Long-term debt (money which an entity has to pay later than 1 year after the current financial period), e.g. long-term part of EC-prefinancing. Equity = Capital and reserves - 50% of intangible assets. Equity consists of the capital, unrestricted reserves and retained earnings, less 50% of the fixed intangible assets. The reduction by 50% of intangible assets is applied because the estimated value can fluctuate. If the total debt exceeds the equity by more than 6 times or if the equity is negative, the solvency is considered insufficient.
Experience in supporting the coordination of expert groups and working groups (as described under 1.4.2.1). Regarding technical and professional selection criteria, a tenderer may only rely on the capacities of other entities where the latter will perform the works or services for which these capacities are required. The entity on whose capacity the tenderer relies, will either assume the role of a subcontractor or fall within the exceptions listed in Section 2.4.2.
Experience in organising events and public relations activities (as described under 1.4.2.2). At least three projects demonstrating capacity to organise events (working groups, policy conferences, workshops, discussion seminars, peer-learning activities, both online and offline) and/or implement communication and public relations activities, completed in the last five years preceding the tender submission deadline, with a minimum value of EUR 50 000 for each of them.
Experience in analytical work and support to the development of policy tools (as described under 1.4.2.3). At least three projects, involving tasks similar to the ones described as analytical work and support to the development of policy tools. The projects must have been completed in the last five years preceding the tender submission deadline, with a minimum value of EUR 100 000 for each of them.
The core team of experts shall consist of a minimum number of 16 members covering a mix of technical and policy expertise in areas under the remit of DG EAC. All core team members should have an excellent command of English (at least C1 level in the Common European Framework for Reference for Languages). The tenderer shall propose a core team composed of different types of experts who will ensure the coordination, implementation and management of the specific contracts and sufficient and continuous quality control. It is expected that there will be stability in the composition of this team. The list of staff in the core team should be kept updated and any changes should be reported to the contracting authority for its approval. Minimum composition (Table 1): - 1 Senior Manager (Level I): Overseeing overall implementation of the Framework Contract, and the specific contracts (project delivery, quality control, management of teams etc.); - 3 Project Managers (Level II): Experience with project management and of teams of at least five people; - 2 Senior Analysts (Level II): Extensive experience in quantitative and qualitative analysis in the areas under the remit of DG EAC; - 10 Analysts and Event Coordinators (Level III): Experience in desk research and drafting of analytical reports. Organising and supporting offline and online events of various sizes and peer learning activities. Moderating and facilitating group and panel discussions and other work modalities in professional events. Coordinating networks, advisory groups and expert groups. Supporting policy actions. Expert level definitions (Annex 6): - Senior Manager (Level I): at least 15 years of professional experience related to the tasks; at least 10 years of experience of project management; at least 10 years of experience in working with international projects at European level; proficient user level (C1) of English. - Project Manager or Senior Analyst (Level II): at least 10 years of professional experience related to the tasks; at least 5 years of experience in working with international projects at European level; proficient user level (C1) of English. - Experts (Level III): at least 5 years of professional experience related to the tasks; at least 2 years of experience in working with international projects at European level; proficient user level (C1) of English. - Other staff (Level IV): skills relevant to supporting tasks; proficient user level (C1) of English.
