legal and regulatory capacity – 14.1. Requirement: All tenderers, i.e., all members of a joint tender and any subcontractors for which a declaration on their honour (see Annex III) is required, must have authorisation to perform the contract under national law.

financial and economic capacity – 15.1. Requirement: Tenderers must be financially feasible and in a stable financial position and have the economic and financial capacity to perform the contract. The annual turnover of the tenderer must be of a minimum value of EUR 600,000.00 for each of the last two financial years. In order to be financially feasible, an entity must be able to demonstrate a favourable total score for the following: liquidity, capability to cover its short-term commitments; solvency, capability to cover its medium and long-term commitments; and profitability, generating profits, or at least with self-financing capacity.

technical and professional capacity – 16.1. Requirement 1 – Authorisation for insurance intermediation: Tenderers must be authorized to carry out insurance intermediation activities.

Requirement 2 – Professional qualifications and experience of staff: Relevant professional qualifications and relevant experience of the tenderer's staff members who will be proposed to provide the insurance brokerage services for the Agency. The tenderers must demonstrate that they have at least two staff members who will be proposed to our account who meet the minimum requirements. The minimum relevant requirements of staff members proposed for the Agency (below which tenderers may not be selected) are: Advanced Diploma of the CII (Chartered Insurance Institute) or equivalent qualification; at least 3 years' experience of working as an insurance broker or client account manager / executive providing insurance advice to international organisation.

technical and professional capacity – 16.1. Requirement 3 – Relevant experience in provision of insurance brokerage services: Relevant experience of the tenderer in provision of insurance brokerage services to at least three international organisations, with a minimum of 400 staff, over the past 3 years where the total combined value of insurance premiums per client was at least EUR 400,000.

technical and professional capacity – 16.1. Requirement 4 – Professional liability insurance: The tenderer must have professional liability insurance in respect of errors, omissions or negligence, the minimum coverage is EUR 1,000,000 per incident of loss and at least EUR 1,500,000 per annum of all incidents of loss in aggregate.

technical and professional capacity – Conflict of Interest: The tenderer and the proposed personnel shall not have any conflicting interest or conflict of interest within the meaning of Article II.1 of the draft framework contract, which could affect the performance of the services of the contract. It follows that the tenderer shall not be in any situation that could compromise the impartial and objective performance of the contract with regard to the rendition of the services and/or supplies.

Compliance with applicable environmental, social and labour law obligations established by Union law, national legislation, collective agreements or the international environmental, social and labour conventions listed in Annex X to Directive 2014/24/EU.

The working language of the Agency is English and the contractor must confirm that it will be able to communicate with the Agency in English for seamless implementation and execution of all the services covered within the scope of the contract, including responsibilities resulting from regulatory requirements such as Health and Safety and Data Protection, as well as for the efficient and timely response in respect to contract management.

3.2. · Minimum technical requirements

Processing of personal data in connection with this service must comply with EU data protection legislation, in particular, Regulation (EU) 2016/679 (General Data Protection Regulation), in such a manner that processing of personal data will meet the requirements of Regulation (EU) 2018/1725. The contractor shall not perform any international data transfer on the personal data processed on behalf of the contracting authority (except in duly justified cases with the prior written authorisation of the contracting authority when full compliance of applicable data protection legislation is demonstrated by the contractor).
