Tenderers must prove that they have the legal capacity to perform the contract and the regulatory capacity to carry out the professional activity necessary for the execution of the works covered by this call for tenders. Tenderers may be natural or legal persons. Tenderers are not required to be constituted in a particular legal form in order to submit their tender. Where tenderers submit a tender through an entity without legal personality (e.g. a branch), compliance with exclusion criteria, selection criteria, rules on access to procurement procedures and the absence of restrictive measures are assessed at the level of the tenderers. In addition, associated entities (see section 2.4) and all subcontractors, including those that do not need to be named in the tender (see section 2.4.2), must not be subject to EU restrictive measures adopted pursuant to Article 29 of the Treaty on European Union (TEU) or Article 215 of the Treaty on the Functioning of the European Union (TFEU) that constitute a legal obstacle to the performance of the contract.
Tenderers must satisfy the following selection criterion in order to prove that they have the economic and financial capacity necessary to perform the contract: the average annual turnover for the last two financial years must be more than EUR 150,000.
The tenderer must be able to provide: a ceremony room for 100 seated persons, a reception room for 1,150 standing persons and a photo area for group photos. The tenderer must also be able to provide: a catering service for 1,150 persons; floral decorations for the ceremony room, reception room and photo area; musical performances; specialised technical support (sound/video/lighting/broadcast). The exception referred to in Part 2 of the Specifications, point 1.A, remains valid during contract performance. For technical and professional selection criteria, a tenderer may only invoke the capacities of other entities if those entities perform the works or provide the services for which those capacities are required. The entity whose capacity the tenderer invokes will assume the role of subcontractor or fall within the exceptions listed in section 2.4.2.
Associated entities (see section 2.4) and all subcontractors, including those that do not need to be named in the tender (see section 2.4.2), must not have conflicting professional interests that could adversely affect the performance of the contract. Where the contracting authority identifies such conflicts of interest, it may conclude that the tenderer or an associated entity does not have the professional capacity required to perform the contract to an appropriate level of quality. The existence of conflicts of interest is examined during the evaluation phase on the basis of the declarations made in the declarations on honour and, where applicable, the letters of engagement (Annex 5.1 and Annex 5.2).
