Tenderers must prove that they have the legal capacity to perform the contract and the regulatory capacity to carry out the professional activity necessary for the performance of the works covered by this call for tenders. Proof that the person responsible for performing the contract (service provider) is authorised to provide nursing services in Italy, Belgium, Luxembourg or the Netherlands depending on the lot concerned, in accordance with the legislation in force in the Member State concerned.
The average annual turnover for the last two financial years must be more than EUR 20,000.
For Lots 7–11: the tenderer must provide at most one service provider who will be responsible for performing the services described in section 1.4 of the call for tenders and for ensuring continuity of service. For all other lots: the tenderer must provide at most two service providers who will be responsible for performing the services described in section 1.4 of the call for tenders and for ensuring continuity of service. The service providers must hold a nursing diploma. This diploma must be issued by a Member State of the European Union or recognised by a Member State as equivalent.
For Lots 7–11: the tenderer must provide at most one service provider who will be responsible for performing the services described in section 1.4 of the call for tenders and for ensuring continuity of service. For all other lots: the tenderer must provide at most two service providers. The service providers must have knowledge of the following languages at minimum level B1 as defined by the Common European Framework of Reference for Languages (CEFR): - All lots except Lots 7, 8, 9, 10, 11, 12 and 13: English or French, minimum level B1. - Lots 7, 8, 9, 10, 11: English and French, minimum level B1. - Lot 12: Italian or English or French, minimum level B1. - Lot 13: Dutch or English or French, minimum level B1.
Associated entities (see section 2.4) and all subcontractors, including those that do not need to be designated in the tender (see section 2.4.2), must not be subject to conflicting professional interests that could adversely affect the performance of the contract. Where the contracting authority identifies such conflicts of interest, it may conclude that the tenderer or an associated entity does not have the professional capacity required to perform the contract to an appropriate level of quality.
