Tenderers must demonstrate that they have the legal capacity to perform the contract and the regulatory capacity to carry out the professional activity necessary to perform the work that is the subject of this tendering procedure. Tenderers may be natural or legal persons. Tenderers are not required to have a specific legal form in order to submit tenders. When tenderers submit a tender through an entity without legal personality (e.g. a branch), compliance with exclusion criteria, selection criteria, rules on access to public procurement and absence of restrictive measures is assessed at the level of the tenderers.
The tenderer must demonstrate the economic and financial capacity necessary for the performance of the contract. The average annual turnover from the last two financial years (2024 and 2025) must exceed EUR 35,000.
The tenderer must demonstrate that it has experience in providing similar services.
The tenderer must demonstrate that it has the human resources necessary for the performance of this contract. A team comprising at least the following profiles is required: (1) Project Manager; (2) Communication and Media Analysis Expert; (3) Political and Drafting Expert.
The entities involved (see section 2.4) and all subcontractors, including those that do not need to be identified in the tender (see section 2.4.2), must not be subject to a professional conflict of interest that could adversely affect the performance of the contract. Where it has established that such conflicts of interest exist, the contracting authority may conclude that the tenderer or entity involved does not have the professional capacity necessary to perform the contract to an appropriate quality standard. The presence of conflicts of interest is examined at the evaluation stage, on the basis of declarations on honour and, where applicable, on the basis of letters of commitment (Annex 5.1 and Annex 5.2). When evaluating tenders submitted under this procedure for the award of a framework contract, the contracting authority may take into account the risk of professional conflicts of interest relating to the nature and subject matter of the specific contracts concluded under the framework contract.
