The subject of this call for tenders is to collect the most recent information on substances to analyse health, socio-economic and environmental impacts in connection with possible amendments of Directive 2004/37/EC on the protection of workers from the risks related to exposure to carcinogens, mutagens or reprotoxic substances at work, and assess the impacts of the identified policy options.

Tenderers can be natural or legal persons. Tenderers are not obliged to take a specific legal form in order to submit their tenders. Where tenderers submit a tender through an entity, which lacks legal personality (e.g., a branch), the compliance with the exclusion criteria, selection criteria, the rules on access to procurement as well as the absence of restrictive measures shall be assessed at the level of the tenderers. Tenderers must prove that they have legal capacity to perform the contract and the regulatory capacity to pursue the professional activity necessary to carry out the work subject to this call for tenders. In addition, involved entities and all subcontractors must not be subject to EU restrictive measures adopted under Article 29 of the Treaty on the European Union (TEU) or Article 215 of the Treaty on the Functioning of the EU (TFEU) that constitute a legal impediment to perform the contract.
Tenderers must comply with the following selection criteria in order to prove that they have the necessary economic and financial capacity to perform the contract.
The tenderer must prove experience in the field of: - Carrying out qualitative research, quantitative analysis and in depth or semi-structured interviews, - performing impact assessment and cost-benefit analysis in line with the requirements of the Commission's Better Regulation Guidelines and its Toolbox.
Tenderers must have at their disposal a team with a proven capability to carry out the tasks described under point 1.4. The tenderer must have expertise and proven experience in the specific field of health and safety at work, especially related to the technical issues involved in the present assignment. This includes expertise and proven experience in applying methods and techniques to carry out the tasks related to the assessment of the health and socio-economic impact of employment legislation in the field of occupational safety and health at EU level. The experts must be also familiar with the EU legislation in the field of health and safety at work. The team shall consist of multi-disciplinary staff and/or have access to external experts on a wide range of relevant disciplines, for example, law, economics, statistics, engineering, occupational health and safety, occupational hygiene, occupational medicine, epidemiology, practical side of workplace risk assessment and management. The tenderer is required to have expertise and confirmed experience in applying methods and techniques for collecting information. The tenderer as a whole must prove the ability and capacity to communicate and deal with undertakings and bodies in the private and public sector, and with enterprises, in particularly with SMEs and microenterprises, and their workers in all the EU Member States concerned by this invitation to tender. The tenderer must have the capacities to interact with all EU Member States (e.g. in terms of language coverage). The tenderer is expected to resort to primary data collection. All data collection tools instruments (especially questionnaires but also interview guides, observation checklists for site visits, facilitation scripts for workshops, etc.) are to be designed from the start with the input of an expert (e.g. in survey methodology, questionnaire methodology, survey design, survey research). The tenderers must provide an organigram on the staff members with their roles and information on the distribution of responsibilities and resources.
The tenderer must prove its capacity to be able to work in at least 10 EU countries. Furthermore, the team shall have the capacities to deal with/cover all Member States.
The tenderer must demonstrate its linguistic capacity to conduct the project in English and carry out language quality checks in English.
