This invitation to tender relates to the management of database subscriptions and other electronic resources. The contractor's role involves processing orders, invoices and payments to suppliers in order to access the databases and other electronic resources, as well as handling access claims and other contractual issues.

15.1 · Legal and Regulatory Capacity

The tenderer is required to fulfil at least one of the following conditions: (a) be enrolled in a relevant professional or trade register, except for international organisations; (b) for service contracts, hold a particular authorisation proving that it is authorised to perform the contract in its country of establishment or be a member of a specific professional organisation. In the case of groups of economic operators, each member will furnish proof of authorisation to perform the contract.

15.2 · Financial and Economic Capacity

Tenderers shall have sufficient economic and financial resources to enable them to perform the contract in compliance with the contractual provisions, given the value and scope thereof. If, on the basis of the information supplied by the tenderer, the European Parliament has doubts about a tenderer's financial resources, or if these are insufficient for performance of the contract, the tender may be rejected without the tenderer being entitled to claim any financial compensation. In respect of the contract which is the subject of this invitation to tender, the European Parliament furthermore requires tenderers to have a minimum financial and economic capacity, which will be assessed on the basis of the following information: - minimum turnover of EUR 1.000.000, for the last three accounting years; - information on the annual accounts.

15.3 · Technical and Professional Capacity

Tenderers must have sufficient technical and professional capacity to enable them to perform the contract in compliance with the contractual provisions, taking into account its value and scale. If, in the light of the information supplied by the tenderer, the European Parliament has doubts about a tenderer's technical and professional capacity, or if it is clearly insufficient for performance of the contract, the tender may be rejected without the tenderer being able to claim any financial compensation. In respect of the contract which is the subject of this invitation to tender the European Parliament requires tenderers to have the following technical and professional capacity: - at least three years' experience in services similar to those required by the contract concerned. Depending on the nature, quantity or scale and purpose of the supplies, services or works to be provided, the technical and professional capacity of economic operators will be substantiated by one or more of the following documents: a list: (i) of the principal services provided in the past three years, with the sums, dates and clients, public or private (if possible); (ii) of at least 20 partners and/or commercial contacts (vendors and/or publishers).

16.1 · Award Criterion 1

The Library is interested in finding contractors with an adequate experience in providing the services object of this procedure to International organisations, covering databases and other electronic resources issued in different parts of Europe and the World. Tenderers shall also describe their client base, client satisfaction and their approach to quality assurance. Q.1. What are your methods to ensure client satisfaction? Q.2. Please provide information on the stability of your client list for the last three years. Q.3. Please explain your methods and organisation of work in particular dealing with international organisations. If relevant, provide details on the standards for management of the staff who will be in charge of this Framework Contract. Will you have a dedicated team or contact person assigned to the European Parliament? Q.4. Please describe your business continuity plan.

16.1 · Award Criterion 2

The EP Library is interested in simplifying the administrative procedures for subscription to certain databases and other electronic resources. The criterion covers: 2.1 Coverage of the service (Q.5 – titles deliverable from Annex VIII list); 2.2 Placing an order for database subscriptions (Q.6 – routines for price quotes; Q.7 – routines for acceptance of orders; Q.8 – compliance with no automatic renewal requirement); 2.3 Subscription periods, fulfilment and delay (Q.9 – shortest possible delay for activation; Q.10 – handling of late activation); 2.4 Service delivery, claims and refunds (Q.11 – routines regarding online access activation); and further sub-criteria as described in Annex I.
