Support to consolidation of Justice Reform in Albania-EU4Justice II

EU4Justice II is the continuation of EU4Justice I (2023-2026) under IPA 2025. The project supports the consolidation of the implementation of the Justice Reform 2016, by ensuring technical expertise to the judiciary, including Courts and Prosecution Offices, legal training institutions, including the Faculty of Law, the governance institutions of the judiciary, as much as the Ministry of Justice and all its subordinate bodies, including legal aid, bailiff and free legal professions (National Chamber of Advocates and Chamber of Mediation). The project is based on four key pillars, being 1. judicial efficiency, 2. judicial independence and accountability, 3. quality of justice and legal education and 4. transparency and access to justice. These four pillars work as a very integrated part of each other, however each aiming to target the most challenging issues identified during the implementation of the reform, as much as consolidate best EU practices already developed by EU4Justice I. A service contract of up to EUR 13,000,000.00 is planned to be contract by the European Commission as the contracting authority, for a four year implementing period (2027-2031). This period of implementation, coincides and covers fully support for the purpose of advancement of EU integration of Albania and Chapter 23 obligations. it aims to set the necessary exchange of experience and adoption of EU practices in the context of pre-accession, and in line with accession negotiations reflected under Interim Benchmark and closing benchmark for Albania.

16. · Selection criteria

Average Annual Turnover: The candidate's or tenderer's average annual turnover of the last 3 financial years for which the accounts have been closed must be not less than 4.800.000,00 EUR.

Assets/Liabilities Ratio: Current ratio (current assets/current liabilities) in the last year for which accounts have been closed must be at least 1. In case of a consortium this criterion must be fulfilled by each member of the consortium.

Minimum Personnel: The candidate or tenderer has, during the current year and the previous two years, on average, at least: 3 personnel directly employed or otherwise legally contracted on a permanent or non-permanent basis in areas of specialist knowledge related to this contract.

Absence of Professional Conflicting Interests: The candidate or tenderer is not subject to professional conflicting interests which may negatively affect contract performance. The presence of professional conflicting interests shall be examined on the basis of the statements made through the Declarations on Honour and, where applicable, the statements and other documents submitted.

Completed Services in Relevant Domains: The candidate or tenderer has completed services under at least: 2 contracts implemented at any moment during the last four years before submission deadline. For each contract, the value of the services completed must not be less than 3.000.000,00 EUR. The completed services are in one or more of the following domains: reform of judiciary, legal reforms, justice and protection of human rights, capacity building of justice institutions, training of magistrates.

Additional · Comparative Criteria

Highest Number of Qualifying Contracts: If more than 8 eligible candidates meet the above selection criteria, the relative strengths and weaknesses of the request to participate of these candidates will be re-examined in order to rank them and identify the 8 best requests to participate for the tender procedure. Criterion 1: the highest number of contracts under which services have been completed that meet the technical capacity criterion.

Additional · Comparative Criteria

Highest Cumulated Value of Qualifying Completed Services: If more than 8 eligible candidates meet the above selection criteria, and after applying additional comparative criterion No 1 it is not possible to identify the 8 best candidates because two or more candidates are tied for the 8th position: Criterion 2: the highest cumulated value of completed services that meet the technical capacity criterion. Additional comparative criterion No 2 shall be applied only to these tied candidates.
