Technical Assistance to the Commission for the assessment of harmonised standards

This procurement ensures the continuity and strengthening of the Harmonised Standards (HAS) Consultants system, which provides the European Commission with technical and administrative assistance to perform its legal duties under Regulation (EU) No 1025/2012. HAS Consultants verify whether draft and final harmonised standards (or parts thereof) developed by CEN, CENELEC and ETSI under Commission standardisation requests comply with those requests and the relevant Union harmonisation legislation—so that the conditions for citing their references in the Official Journal of the European Union (OJEU) are met in accordance with Article 10(6).

3.2.1 · Legal and Regulatory Capacity

Tenderers can be natural or legal persons. Tenderers are not obliged to take a specific legal form in order to submit their tenders. Where tenderers submit a tender through an entity which lacks legal personality (e.g., a branch), the compliance with the exclusion criteria, selection criteria, the rules on access to procurement as well as the absence of restrictive measures shall be assessed at the level of the tenderers. Tenderers do not need to prove specific legal and regulatory capacity to perform the contract.

3.2.2 · Economic and Financial Capacity

Tenderers must comply with the following selection criteria in order to prove that they have the necessary economic and financial capacity to perform the contract.

3.2.3 · Technical and Professional Capacity

The tenderer must prove experience in the following four fields: - drafting reports on subjects related to the EU Single Market for goods, and/or surveying techniques on economic aspects related to the EU Single Market for goods; - collection of data and/or elaborating of questionnaires; - statistical editing and/or quantitative analyses and/or conducting data analysis; and drafting recommendations on how to improve the efficiency and impact of complex workflows.

3.2.3 · Technical and Professional Capacity

The tenderer must demonstrate sufficient ability and means available to carry out the tasks, notably in terms of management of human and technical resources, including relevant IT tools available and quality systems in place.

Educational and professional qualifications of the tenderer and in particular, those of the person or persons responsible for providing the services or carrying out the tasks under this contract.

3.2.3 · Technical and Professional Capacity

Involved entities (see Section 2.4) and all subcontractors, including those which do not need to be identified in the tender (see Section 2.4.2), must not be subject to professional conflicting interests which may negatively affect the contract performance. Where the contracting authority has established such conflicting interests, it may conclude that the tenderer or an involved entity does not possess the required professional capacity to perform the contract to an appropriate quality standard.
