Tenderers must demonstrate that they have the legal capacity to perform the contract and are authorised under the applicable regulations to carry out the professional activity required to perform the works covered by this tender. Tenderers may be natural or legal persons. Tenderers are not required to adopt a specific legal form in order to submit a tender. When tenderers submit a tender through an entity that does not have legal personality (e.g. a branch), compliance with the exclusion criteria, selection criteria, rules on access to procurement and the absence of restrictive measures shall be assessed at the level of the tenderers.
Tenderers must meet the following selection criterion to demonstrate that they have the required economic and financial capacity to perform the contract.
The tenderer must demonstrate that it has experience in similar services. Regarding the selection criteria on technical and professional capacity, a tenderer may only rely on the capacity of other entities when those entities perform the works or services for which that capacity is required. The entity on whose capacity the tenderer relies shall take on the role of subcontractor or falls under the exceptions referred to in point 2.4.2.
Each person submitting as sole tenderer, as a member of a joint tender, or as a subcontractor declares whether they are in a conflict of interest that could negatively affect the performance of the contract.
