Frontex will use the Framework Contract (FWC) established following this procurement procedure to:  support the operational needs of its fleet, in particular for the positioning and repositioning of vehicles.  secure access to appropriate, reliable and flexible vehicle’s transport solutions, while ensuring cost efficiency and competitive pricing conditions.

III.4.1 · Legal and Regulatory Capacity

The Tenderer and any involved entity is asked to prove that it has legal capacity to perform the contract and the regulatory capacity to pursue the professional activity necessary to carry out the work subject to this call for tenders.

III.4.2 · Economic and Financial Capacity

Tenderers must comply with the following selection criteria in order to prove that they have the necessary economic and financial capacity to perform the contract.

The tenderer must demonstrate full compliance with applicable vehicles' transport regulations and adequate insurance coverage for transport operations.

The tenderer must demonstrate the capacity to ensure consistent quality in the supply of vehicle transportation through the implementation of appropriate quality assurance and performance management measures.

III.4.4 · Professional Conflicting Interests

Any entity involved in the tender must not be subject to professional conflicting interests which may negatively affect the contract performance. Where the Contracting Authority has established such conflicting interests, it may conclude that the tenderer or an involved entity does not possess the required professional capacity to perform the contract to an appropriate quality standard.

5. · General Minimum Requirements

All Contractor's staff (as indicated under art.7 of this ToR document) shall possess at least the following qualifications: At least five (5) years of professional experience in contract management, involving vehicle's transport services or similar. Command of English (at least to B2 level of the European Framework of Reference for Languages).
